According to the loi de finance rectificative pour 2008 (Finance (Amendment) Law for 2008) (article 35b of the general tax code): Natural persons selling electricity produced by solar arrays of an installed capacity equal to or less than 3kWp are exempt from income tax on the income from this sale. This law applies as from the 2008 tax year.
